Controversy Grows Over Airbnbs in Shenandoah

Residents expressed strong differences of opinion on the subject of airbnbs (also known as short term rentals or STRs) during the last Planning & Zoning meeting held May 16. Generally, STRs are temporary rentals under 30 days.

One resident advised the commission of a recent incident involving about 30 cars parked along her street and several people walking across her lawn. She later learned that the home is a permanent STR, although she said it was her understanding the city did not allow such rentals.

Another resident said he is not in favor of STRs because of the negative impact on quality of life, and a third questioned why there was a proposal to change the Integrated Development Code (IDC) by removing STRs from the prohibited list. She said there are at least eight such STRs currently advertised within city limits.

However, another resident said he did not believe the city should take away the rights of property owners by prohibiting STRs because many people are experiencing economic hardship and need the income. In 2018, the Texas Supreme Court ruled in favor of a homeowner who challenged Austin’s STR ordinance. 

When asked whether the city allows STRs, Chairman Wes Stephens said yes, it does (17 minute mark, May 16 meeting). However, his comments appear to conflict with section 4.2.9(d)(7) of the IDC (page 44), which specifically excludes “inns” and “tourist homes” from the types of home businesses allowed by the city. During the March 21, 2023 P&Z meeting, city attorney Bill Ferebee said STRs are “technically” not allowed, but indicated the subject was open for further consideration. City officials did not respond to the Sentinel’s request for clarification. 

Regulation of STRs across Texas varies from city to city, and although bills have been introduced in the Texas legislature to limit the ability of local governments to regulate STRs, none of them have passed. Most recently the city of Plano decided to ban STRs for a one year period. The Woodlands allows them, but owners must apply for a permit

A group known as the TX Neighborhood Coalition is working with local communities across the state to oppose STRs, citing concerns with noise, safety and parking that accompany these types of rentals.
